My Crackhead neighbor threw glass in my yard on tuesday, I went over and asked if they had even seen any thing not accusing. Then the Id10t, pulls out a 22 rifle (at the time I thought it was a .17 pellet gun) Says I sleep with this every night, and aint afraid to use it. (I leave) I was going to make a statement the next day when,
Wednesday walking up the drive way he shoots out the door 2 times then jumps out and says hey dumbass its real.
I called the cops he got arrested.
Breach of peace, and some other lame ass charge.
What are the laws regarding shooting back?

I'm not sure I get what your asking...as in the laws for if you decided to shoot back at him? The way I see it, you absolutely cannot pull a gun out and shoot someone unless you truly believe your life is in danger. If thats the case, and it appears to be a life or death situation, you should get off scott free. Kind of a tricky call though. It's one of those unspoken territories where theres no clear cut answer.

In CT, if you can retreat you must. the threat must be imediate. So if ou go inside and get your gun and shoot back, you prolly will get in trouble.

I'd get a concealed carry permit, esp cause you got him arrested once, and clearly he's still gonna be your neighbor. Next time he shoots at you, light his ass up.

How does one safely retreat from someone with a long gun in an open space??
Also you should go to the police department and tell them you want to press charges I suppose. Kinda sounds like the arresting officer(s) didn't want to deal with shit.

Its not assault with a deadly weapon, as you were never assaulted (injured)

You can ask that he be charged with 2nd degree threatening (misdemeanor), unlawful discharge of a firearm (misdemeanor).

You can also ask that 2 police officers petition a judge for a seizure order of the firearm in question.
